The aggregate liability of Matt St. Jean for all claims arising from or relating to the Website or these Terms will not exceed one hundred U.S. dollars ($100).

These limitations do not exclude liability that cannot lawfully be excluded or limited.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Matt St. Jean and his agents, affiliates, and service providers from third-party claims, damages, liabilities, and reasonable attorneys' fees arising from or relating to your unlawful use of the Website, material you submit, your fraud or violation of these Terms, or your infringement of another person's rights.

Before filing a lawsuit arising from the Website or these Terms, the complaining party must send a written notice to hello@mattstjean.com describing the specific issue, the dates involved, the alleged injury, and the relief requested. The parties will attempt in good faith to resolve the dispute for 30 days after receipt of complete notice before filing suit. This requirement does not apply when a claim would otherwise expire or when immediate injunctive relief is reasonably necessary.

These Terms are governed by the laws of the State of Maine, without regard to conflict-of-law principles. Subject to Section 16, exclusive jurisdiction and venue will lie in the state courts of Cumberland County, Maine, or when federal jurisdiction exists, the United States District Court for the District of Maine. Each party consents to personal jurisdiction in those courts.

To the maximum extent permitted by law, any claim arising from or relating to the Website or these Terms must be filed within one year after the claim accrued. This contractual period does not apply where applicable law prohibits shortening the limitations period.

To the maximum extent permitted by law, each party knowingly and voluntarily waives the right to a trial by jury in any dispute arising from or relating to the Website or these Terms.

To the maximum extent permitted by law, each party agrees to bring claims only in its individual capacity and not as a plaintiff or class member in a class, collective, or representative action.

We may update these Terms by posting a revised version and changing the "Last Updated" date. Material changes will receive additional notice when required by law. Your continued use after revised Terms become effective constitutes acceptance to the extent permitted by law.

These Terms and the incorporated Privacy Policy constitute the entire agreement concerning use of the Website. If a provision is held invalid, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent.
